Terms of Service

These Terms of Service (“Terms”) govern your use of OverWithTech (“OverWithTech,” “we,” “us”) — the SMS-first website service available at overwithtech.com and by texting our platform number. By texting us, creating an account, or subscribing, you agree to these Terms. If you don’t agree, don’t use the service.

1. The service

We build, host, and maintain websites for small businesses. You provide your business information (by text or dashboard); we generate your site, host it, and make changes when you ask. We host your content on infrastructure we manage. You are responsible for the accuracy and legality of the business information, text, images, and other content you provide.

2. SMS program terms

OverWithTech SMS program. By texting SITE (or any keyword) to our number, you consent to receive recurring automated text messages from OverWithTech about your account, your website, and your leads.

Lead notifications: if you enable lead capture, we forward form submissions from your website to your phone by SMS. You control this in your settings; heavy bursts may be batched into digests.

3. Plans, billing, and refunds

Plans are billed monthly through Stripe, our payment processor. Plans are month to month — no contracts. You can cancel any time by text or from your dashboard; cancellation takes effect at the end of the current billing period.

30-day money-back guarantee: if you’re not happy within your first 30 days as a paying customer, contact us at support@overwithtech.com and we’ll refund your first payment.

4. Fair use — “unlimited changes”

Every plan includes unlimited changes to your website with no meters and no per-edit fees. “Unlimited” means what a real business reasonably needs: updating hours, photos, services, pages, colors, copy — as often as you like. It does not mean:

5. Your domain, your content

You own your domain. When we register a custom domain for you, it’s registered for your benefit and it’s yours. If you cancel, we’ll cooperate in transferring the domain to you or a registrar of your choice (standard registrar transfer rules and fees may apply).

You own your content. The business information, text, and images you provide remain yours. You grant us a license to host, display, adapt, and back up that content solely to provide the service. We host your website on our infrastructure; if you leave, we’ll take your site down on request and you keep your domain and your content.

Site designs, templates, generation systems, and the platform itself are ours (or our licensors’) and remain so.

6. Acceptable use

You may not use the service for anything unlawful, deceptive, or harmful — including sites that infringe others’ rights, impersonate other businesses, distribute malware, or promote illegal activity. We may suspend or remove sites that violate this section.

7. Email and telemarketing compliance (CAN-SPAM / TCPA)

Our own messages to you comply with the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA): we only text you with your consent, we identify ourselves, and every message channel has a working opt-out (reply STOP for SMS; unsubscribe links in marketing email). If you use your website or lead data to contact your customers, you are responsible for your own CAN-SPAM/TCPA compliance — get consent before texting or robocalling anyone, and honor opt-outs.

8. Copyright & DMCA

We respect intellectual property. If you believe content hosted on a site we serve infringes your copyright, send a DMCA notice to our designated agent: support@overwithtech.com with the subject “DMCA notice.” Include: identification of the work, the infringing URL, your contact information, a good-faith statement, a statement of accuracy under penalty of perjury, and your physical or electronic signature. We will remove or disable access to infringing material and may terminate repeat infringers’ accounts.

9. Service availability & changes

We aim to keep your site up around the clock, but the service is provided “as is” and “as available.” We may modify features over time. If your payment fails, your site enters a grace period before being parked; nothing is deleted immediately, and you can reactivate.

10. Disclaimers & limitation of liability

To the maximum extent permitted by law, OverWithTech disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Our total liability for any claim arising out of the service is limited to the amounts you paid us in the twelve (12) months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business.

11. Termination

You can cancel any time (see Section 3). We may suspend or terminate accounts for violation of these Terms, non-payment, or abuse. On termination we’ll cooperate in transferring your domain (Section 5) and, on request, provide an export of your leads and business information within a reasonable period.

12. Changes to these Terms

We may update these Terms from time to time. If a change is material we’ll notify you (by text or email) before it takes effect. Continued use after the effective date means you accept the updated Terms.
